    Default Can Someone else Appear in Court for You if You Are Unable to Attend

    My question involves criminal law for the state of: Kentucky

    My husband is scheduled to be in court tomorrow morning for a charge of Theft of Services. He has no criminal background and it is due to electric illegally being hooked up at a shop that he rents. He did not hook the electric up illegally, it was on when he rented the place. It is not a felony charge or anything like that. Long story short he is out of town for training for his work, and I was going to go in his place to let them be aware, and to maybe get his court date rescheduled. I just want to make sure that he wont get a warrant or anything for failure to appear if I go in his place. Any knowledge on this would be greatly appreciated.

    You can *NOT* go in his place. He may very well get a bench warrant for not appearing. A lawyer MIGHT be able to appear for him. He should request a rescheduling/continuance (depending on what the appearance is to be) or get a lawyer involved.

    Eeekkk! Ok that is not what I wanted to hear, but I appreciate your response. I do not know what to do at this point

    If he's out on a commercial bail bond call the bail bondsman. Now.

    Hope I do not make myself look dumb, but I am not sure what type of bond it is....I just went and signed something.

    Where is his lawyer? He needs one. Most likely this is a felony trial (I bet the power bill is in excess of $500)...why on earth are you guys waiting for the last minute. At this point, I would call your husband and tell him to high tail it back to court. The court doesn't give a hoot about his excuse for not making it. He might have gotten a continuance if he asked in a timely fashion.
