    Default Can a 60 Month Plan Be Reduced to 36 Months

    My question involves bankruptcy in the state of: New York

    I'm in a Chapter 13 bankruptcy. Plan is 60 months. I must turn in all tax returns for each year of the plan. My plan consists of only my student loans $42,000 and I gave the house back to the bank so all money owed on the home was expunged. Right now I'm in my 33rd month of plan. My question is this. . .

    Can I ask the courts to reduce the months of my plan from 60 months to 36 months? Can I ask to keep my tax returns? Please advise.

    Sounds like you are in a 60 month Plan because you were over median income when you filed. If your "commitment period" is 60 months, it is highly unlikely that you can get out in less time unless you pay 100% of all allowed claims.

    If your Order Confirming requires the turnover of the tax refunds and you need to divert them for some necessity contact your Trustee to see if you can work something out - better yet, discuss this with your attorney if you have one.
