    Default Bar Fight

    My question involves criminal law for the state of: LA

    last year my husband was involved in a bar fight with another man, both had been drinking. the other man insulted my husband and crowded his personal space. my husband reacted to the the threat by punching the man 1 time, as a result of the punch the man hit his head on the ground and was unconscious for a brief period of time and later transported via ambulance to the hospital where he required a few stitches and was released later that night. my husband and the other man have mutual aquaintances so he was quickly identified but left the scene before police showed up for fear of being arrested for public intox at least. my husband called the police station that night and said he was involved in a fight and left his name and cell phone number. a police report was issued that night, we have not seen it but believe that he has witnesses in his favor. we offered to pay for medical expenses but the other man has since hired legal counsel. my husband seems to think that because it was like 6 months ago and nothing has happened yet, that nothing will. should we hire a lawyer? is his lawyer biulding a case?how will we know if charges are filed? what are possible scenarios? jail? probabtion? settle out of court? does that depend on his lawyer or the police report or what? my husband has no proirs and a clean record...any advice would be appreciated.

    You believe your husband has witnesses in his favor? I doubt that very much. Your husband punched a guy's light's out for insulting and crowding him. That's assault and battery, and that's actionable.

    Not yet. You should get yourself down to the police station and get a copy of the report, though.

    is his lawyer biulding a case?
    One would imagine.

    how will we know if charges are filed?
    Your husband will either be summoned to court or arrested.

    what are possible scenarios?
    Until he's actually charged with something, it's difficult to say.

    I think the more likely problem is going to be a civil suit. If the recipient of the punch doesn't file one, he's absolutely stupid.

    I don't know if I have anything against fair bar fights, but if some guy was taken out with one punch, it means a big bully type versus a little puny guy.

    Next time, he can avoid a civil suit if he throws a punch at Mike Tyson. He may see it coming and react. Or against a concealed-carry type who has had a really bad day.

    Sickening, frankly.

    my husband isnt the bully type at all and the guy wasnt puny at all either,if fact the other guy was bigger than my husband, i doubt that matters at all either way. i agree bar fights are sickening and lead to nothing but pain and heartache for the parties involved as well as their loved ones. Its truly and unfortunate situation from anyone's perspective. the other guy has witnesses...what charge would you expect in a situation like this?

    After six months, I doubt any criminal action is going to be pursued.
