    Default Restitution in Hit and Run

    My question involves a traffic accident in the State of: California

    Was in a hit and run accident. Person who hit my car from behind was arrested. DUI, suspended license, no insurance, and hit and run. DA has sent me a restitution form. Two questions-

    1. Should I add cost of repairs in the restitution form - event though my insurance paid for it..
    2. Can I include loss of value of my car due to accident. It is just one year old car. There is no receipt for it - it is a general concept that cars involved in accident loose value.

    You should talk to your insurance company about this. Since the insurance already paid, any restitution for repairs should be paid to the company, not you. So, the drunk should pay the insurance company directly. If the drunk paid you, and you did not reimburse the insurance company, it could be construed as insurance fraud. Talk to your insurance company and see how they want to handle it.

    You can ask, but I’m not confident that the court will grant it. How would you determine a specific dollar amount for your decreased resale value?
