    Default Landlord Gave Police Key to Enter My Unit for Suspect Who Was Noton Lease

    My question involves an eviction in the state of: CALIFORNIA
    THE LANDLORD GAVE THE POLICE A KEY OR THEY PICKED THE LOCK BECAUSE THEY CAME IN THROUGH A LOCKED DOOR. THEY SAID THEY WERE THERE ON A PROBATION CHECK FOR MY BF WHO DOES NOT LIVE WITH ME BUT WAS VISITING AT THE TIME. MY NEIGHBOR WAS INVOLVED IN A BURGALRY AND HE TOLD DETECTIVES MY BF WAS HIS ACCOMPLICE. WHEN THEY CAME IN I INFORMED THEM HE DOESNT LIVE WITH ME BUT THEY SEARCHED ANYWAY. THEY FOUND A SMALL AMOUNT OF METH AND A PARAPHNELIA AND I WAS ARRESED AND HEWAS ARRESTED FOR POSSESION. I WAS THEN SERVED EVICTION NOTICE FOR BEIGN A NUISANCE AND DRUGS ON PROPERTY. I PLEAD NOT GUILTY BECAUSE THEY ILLEGALLY SEARCHED MY HOME CAN MY LANDLORD STILL EVICT MR IF I CAN GET A MOTION TO SUPRESS ALL EVIDENCE?

    Please do not type in caps, it is rude. It sounds like they knew you were hiding him and had probable cause to search for him. Sucks to be you. Pick a better bf if you are going to keep drugs around. Whether it is suppressed or not, you are getting evicted.

    Yes, the landlord can complete the civil process to evict you regardless of whether or not the evidence in the criminal case against you is tossed or not.

    Interesting that he doesn't live with you but happened to be there.

    Chances are they did their homework and found somewhere that your boyfriend indicated your apartment as his home address. Likewise, if he had his personal property there (clothing, personal effects, etc.) and/or received mail there, he could also be considered a resident as far as they are concerned.

    If you hook up with a guy who is under court-ordered supervision, you have to accept the pitfalls of such a relationship. It is never a good idea to hold contraband in a residence where a probationer or a parolee spends a great deal of time.

    And, as was mentioned, the landlord can still move to evict whether you are prosecuted or not. Clearly you are allowing undesirables on the property. You are free to go to court to challenge the eviction, however.
