    Default Children Removed After Domestic Fight Between the Parents

    My question involves child abuse or neglect in the State of: Utah how can a state take your child away for a domestic fight. Between u and the mother one time thing..and they took them from both of us. We never been involved or had any criminal history just one simple argument not even physical.

    They only charge us with that but in fact they said it was child abuse to have my child in a commercial vehicle but people have kids in motor home all the time

    Me and my wife was homeless for a short time I decided to get my commercial drivers license and was saving up money to buy a house. After about a year my wife sister reported it. We were pulled over and they said we were fighting, my child was 2 at the time they took are parental rights away and her sister keep are child.

    TIME LINE please.

    WHEN did this happen, and in what order. You were pulled over for what reason? Were your parental rights TERMINATED by the court, or did they simply remove custody?

    No are parental rights were taken this happen over 4 years ago.

    So you and wifey were running around the USA, with a baby in a semi truck. I bet you did not keep the baby in a car seat on the passenger side. I also suspect the child was not receiving regular hygiene care either.

    So, you, your wife, and child were living in a commercial truck that you were also driving for employment? There has to be more to the story than just that. Were you hauling hazardous materials that your child was in danger of being exposed to? Did you take your child into hazardous conditions (for a 2 y/o child) during the day, while you were working? Were you able to provide your child with basic needs like food and sanitary facilities? I have a hard time believing that your parental rights were terminated by the court (usually a lengthy process) just because you were sleeping in the cab of a semi. Even in Utah, the courts don’t consider homelessness to be a valid reason to permanently remove a child from parents.

    I agree...but it would seem that the fighting in the presence of the child might have been the straw that broke the State's back. If the child was deemed to be in imminent danger, I can see something drastic happening at least in the short term. But in the long term? Not so much. There is far more to this story, but without further details it's difficult to go much further.

    My hunch is that child services were involved at least once before, and what happened was the result of a long-standing problem.
