    Default Can My Live-in Boyfriend Leave with My Property

    My question involves personal property located in the State of: New York

    My boyfriend and I of 8 years and who is also our 6 year old daughter's father have lived together for 8 years. He however has not worked in years and I have soley been supporting the household. "We" have bought items with my tax money from my wages and we do have items in our house such as the dining room table and shelves, etc. that are his mother's property. I am in the process of breaking up with him but he swears he is not leaving with nothing meaning by the computer and desk, plasma flat screen tv, couch, playstation 3, etc. Which is the stuff I had bought with my taxes.. fyi I do not have the receipts to these items execpt the tv and the ps3 but he holds them hostage somewhere and won't tell me where. Does he have the right to take these items if I remove him from the house?? I mean he has already sucked me dry financially.. and I will involve the police if I must but I need to know if I have a leg to stand on. I don't want to come "unarmed". And I do already have a limited order of protection against him but is about to expire in the next few months.

    You are in a tough spot that the cops will likely not want to get too involved in. If he attempts to remove items that are not his, I would call the police. They are going to do one of three things:

    1. refuse to attend to what they see as a civil matter
    2. respond and tell the ex to leave the items at the home and seek redress in civil court
    3. allow the ex to take the items and to you to seek redress in a civil court.


    They are not going to be the arbiters of who owns what from the sidewalk and will basically attempt to maintain order and little else.

    Yea the police HATE him with a passion. He has a constant criminal record and is well known with them. And this is coming from a person who doesn't have the slightest bit of a record. He is more than welcome to take what ever is rightfully his. Not gonna stop him there. But when it comes to my stuff, even though I know it would be a small price to pay to get him away from us (my daughter and myself) and out of the house, I feel like he has already taken and used me enough.
