    Default Is a Divorce Valid After it Has Been Vacated

    My question involves a marriage in the state of: Louisiana

    My divorce was filed and we got a judgement. However, the husband contested the divorce and the divorce was made to be null and void because of separation dates. In the judgement that makes the divorce null and void, the wrong suit number is voided. The suit number that is dismissed is not the suit number of the divorce. Does this make that judement invalid? A second divorce was filed and granted but my question is if the wrong suit number does make the first voiding invalided, does the first divorce still stand?

    If a second divorce was filed and granted, then you're divorced and the first action is irrelevant. If you need to know for some reason if the first divorce was valid, such as might be the case if you remarried before entry of the second divorce judgment, have a lawyer review the court file.

    I know I am divorced. The question is whether the overturning of the first divorce is valied due to the mistake. If there was a mistake in voiding the first divorce wouldnt the first divorce still be valid?

    the case number is simply a reference number. It does not affect the case. Unless there were two divorces involving the same two people during the same time period (as there are many dates in a divorce action that would show when it was being conducted), the reference to an incorrect file number is a correctable error but even if not corrected, still does not alter the judgement resulting from the action.
