    Default Tax Garnishment for a Defaulted Student Loan

    I have defaulted on my student loan. I know that I have and know that I owe. I am talking with the company. Last year I received a letter stating that I would be eligible to have my tax refund garnished if I did not start paying. I did talk with the company at that time, I still have not been able to make a payment as I am unemployed. Is there a way to find out if they did send me to have my tax refund garnished. Would they have to tell me that I am going to have the refund garnished? My husband and I file together and he is the only one that has been working, I know that we can file the injured spouse form but I don't know if we should file taxes separately, file that form, or just file and hope they don't take our refund. Just wanted to know if there is a way to find our for sure, so we know what would be our best option for filling taxes. Thanks

    Your best option is to file jointly and allow any refund to be garnished and applied to your student loan balance. This will lower the overall interest and penalties you are being charged on it.

    The letter you received is likely the only notice you will receive; they have basically told you of their intent to levy your tax refund.

    You will find out when you file; if you E-file it will appear within a few days (there will be a numerical reference).
