    Default 3rd degree misdemeanor at a Michigan mall

    my daughter and her friend were just recently caught shoplifting at the mall a few days ago. my daughter 16 and her friend 17 decided to make a ver poor choice and steal some clothes from a few stores. they were caught in the department store pennys. they were told that they wouldnt get introuble or charged for what they took from the other stores just as long as they confessed to what was not theirs. my daughter had an extra bag on her because her friend picked her up straight from work and she had stuff for spending the night as well. obviously she did not have a recit for all this because it was already a bit older clothes. but the items were still taken from her.

    my questions are the following...
    - even though it was their first time are they really banned from the mall and can they be banned from the mall when they do not have evidence of the girls stealing from the other stores?

    - will this remain on their record even though it was 3rd degree and first offense?

    - will they reallly have to go to court or will they just get it all in the mail?

    -will this effect future jobs?

    -what will be the difference on the charges since my daughters friend was considered an adult and my daughter only a juvenile?

    -how bad will the fine be?


    i would highly apperciate it if there is any one on this site wh can answer my questions.

    I think your questions are very good ones. Considering that she stole from other stores in combination with the situation at Penny's, it would be impossible to know the potential outcome without more information.

    I think she'd do well to speak with an attorney and explain the entire story very candidly. You didn't even mention whether or not the police were involved; that's a major "biggy" which will greatly affect the outcome.

    I can't imagine that the used clothing items will be too difficult for anyone to sort out from the newly pilfered ones. Don't panic...but do get some good advice, locally.

    yes the mall police came and were involved but they weren arrested or anything. sorry i forgot to mention that.

    but since my daughter is only 16 does she need an attorney i now her friend will since her friend is considered an adult
