You are absolutely legally entitled to file for bankruptcy and include their debt in your filing. If they want to contest, they will need a reason and they can state that reason at the 341 meeting after the bankruptcy has been filed - after they file the adversarial complaint. However, if they do file, you MUST respond - you cannot ignore it.

However, as with anything, I strongly suggest you speak with a bankruptcy attorney. BK is not something most people can do without an attorney; it's not impossible (for example if yours is a no-asset Ch. 7), if you're willing to seriously educate yourself, but I wouldn't recommend it.
