    Default Rules for a Simple Assault Charge

    My question involves criminal law for the state of: North Carolina

    My friend and I went out for a night of casual dancing. We were consuming alcohol, as we had a designated driver. On the way home, in the car, my female friend and I got into a confrontation. She was currently staying with my husband and I, and had been for the previous 3 months. She has never paid any bills, including rent, utilities, or anything while living with us. The confrontation turned into a huge word fight with harsh words involved, and when we arrived home, I told her to move her stuff out. I threw one of her personal belongings out the door, and she decided she'd call the cops and tell them I trashed her stuff and assaulted her. She told the deputies who arrived that I had "beat her face in" on the car drive home. She had absolutely no marks on her face as this was a lie. She also told them I was trashing her room, including her computer. The officer kindly asked me to bring her computer outside, and I did so in rage, ripping it out of the wall and accidentally dropping it causing the monitor to break. The cops said nothing about the damage, and advised my friend to go home and sort things out the next day. The next morning she came back with a deputy and asked to get some of her personal belongings. I complied and pack her stuff myself and took out some of her things to the officer. I told the officer I would need more time to gather her things, as she was no longer allowed on my property. I packed her stuff and left it on the porch later that afternoon, and she came and got all of it off the porch. She is now texting me and saying that if I pay her for her broken computer monitor she will not press charges for me "beating her face in" and "ripping her hair out." I am just curious if she would legally have a case? Our driver who was with us is her best friend, so I know he will testify as a witness to her side. She is using bribery against me basically threatening me that if I do not comply with the requests, she will file charges. Can I be held accountable for an assault charge, since it has been 4 days, and no statements, picture, or claims of any sort were documented the night it happened? I honestly do not want to have to go to court and pay the court costs, and she's only asking for 150 for her monitor. Also, if charges were filed, she would have a right-hand witness as I previously stated. I have never been in any trouble before and I am just in shock this is even happening. I do not want to pay her for no reason, but also I do not want to go to court and be at risk for any serious conviction. Any advice would be extremely helpful! Thanks!

    While it is wrong for her to threaten a false accusation against you, why should you NOT pay for her monitor? You admit you broke it "in a rage, ripping it out of the wall." Therefore, you should pay for it. If all she is asking for is what you are legitimately responsible for, what is the issue? $150 sounds reasonable for a computer monitor to me.
