15 Year Old Suspended for Distributing Drugs at School

My question involves criminal law for the state of: ohio
My 15 year old daughter brought a small amount of marijuana to school last week in an attempt to "get rid of it".
She gave it to 2 other students,who were then caught with it.
They gave my daughters name to the principal who then questioned my daughter.She was co-operative and admitted she gave it away.
She is now suspended from school for 10 days with an expulsion hearing on the way.She was charged with possesion/distributing on school grounds......not sure yet weather the law will be involved.
My question......She was not actually caught with anything.....or caught distributing.How does this work legally?

Although,like I said ,she did admit she had it.
I believe 10 day suspension is extreme,as this is her first time in trouble and she is a good student with good grades.
The other 2 students recieved the same punishment.
Please help!

Frankly, she's lucky she wasn't expelled on the spot.

It doesn't matter that she wasn't caught red-handed - she admitted the crime. If she is charged, she needs to speak ONLY to her attorney, and say nothing else to anyone.

As we tell the minors who post here after shoplifting and think that their GPA should somehow mean the judge will go more easily on them, the fact that she is a good student with good grades means she should have known better. It does not mean that she is somehow exempt from receiving the same punishment that a lesser student would get.

Isn't there a Federal "Drug Free School Zone" law? She would definitely be in violation of that.

If she wanted to just "get rid of it", there are plenty of trashcans about. Heck, she could have simply thrown it to the winds and be removed of possessing it. The fact is; she intended to and intentionally distributed it to her friends. She is guilty of distibuting mj on school grounds. The really bad thing: she admitted to it so if this does become a criminal issue, she has already pretty much sealed her fate.

As to a 10 day suspension being extreme:

sorry but expelling her permanently would not be extreme in my eyes. She committed several crimes, not just "whoops, I broke a rule" types of acts. She could go to jail for this.

and since she does get good grades, she should be smart enough to know to not break the law.

I'd be asking her where she got it, how often she has used it, has she used anything else? Has she tried alcohol, huffing, any other drugs? And forbidding her from hanging out with whomever she got it from and gave it to. Be understanding, not defensive or accusatory - just tell her you need to talk about this.

She most likely will be expelled....we have an expulsion hearing next week.
As far as her being a good student...yes,she does get good grades,however she lacks some major common sense!
We have talked to her,she is on lock-down here at home...no cell phone,internet and will not be allowed any contact with anyone involved in this incident.period.
There is some complications to this whole mess....she was actually" returning" the marijuana back to the original student she got it from.....who is/was her boyfriend!
also...we just heard that he and the other student involved only recieved 5 days suspension if they take a drug education class.
I am just curious why the class/5 day suspension was not an option for my daughter as well??

I suspect it is because she took the mj to school and the others didn't.

The punishment received by other children is really not relevant. And, for legal reasons, the school is not likely to discuss the situation of those other children with you (nor should they). About all you may know of their situation is what the student rumor mill passes along which is not likely to be completely accurate.

She will be darn lucky if the police do not get involved. As mentioned, if she is not being sent up for expulsion, she got off very light! Out here she would generally be facing expulsion AND prosecution.

Stand firm with her, and keep a tight rein on her. It sounds as if she needs a serious "Ah ha!" moment in her life and needs to realize that it's time to grow up a little and develop some common sense.
