    Default Second offense shoplifting

    Got caught second offense shoplifting in michigan. The first offence was a 3rd degree retail fraud happend a year ago and finished my 6 months probation time and payed the fine. The second one was yesterday for $150 . The police was not involved, but It is very possible that the store called them after I left. What would happen? Would the Police come and arrest me. What is the possible punishment for the second offence. Any jail time before the court hearing. Any possiblilty I got only probation without jail. I knwo I am stupid, but it happend. Help

    You can expect a civil fine from the store, which I'm sure you already are familar with what that is.

    If the store decides to call the police and have you charged criminally, it is "stepped up" because of the prior.

    For example, your 3rd degree retail fraud could have had a penalty up to 93 days in jail and/or $500 fine or 3 X the value of the merchandise.

    As you see you were given a great break, most likely because this was your first offense.

    Now 2nd Degree retail fraud could have a penalty up to 1 year and/or a $2000 fine or 3 X the value of the merchandise.

    Even though you are not sure you are going to be charged criminally, it still wouldn't be a bad idea to start saving up your money.

    Two things:

    1) You need a different career/hobby - you absolutely suck at shoplifting to have been caught twice in a year. Besides the fact that you are horrible at shoplifting, you need to take a long hard look at your life and see what it is that is making you shoplift. I would suggest that you seek counseling.

    2) What kind of forms did you sign and what retail establishment did you steal from? I can tell you whether or not you will be prosecuted after the fact by knowing, 1 - what area you are in, 2 - what store you stole from, 3 - what amount you took. You have already answered 1 and 3, so detail what you took and where you took it from and we can go from there.

    How old are you and what gender are you? Do you have a valid ID? What happened during the detention? These are not pointless questions, they will help me in helping you with your dilema.
