    Default Cited for Speeding in a School Zone

    My question involves traffic court in the State of: Colorado

    This morning at 10:15 I received a speeding ticket for going "School Zone- 10 to 19 MPH - Over Speed Limit". I was going 46 in a 35. The school zone lights were not flashing and the location where the officer clocked me was one block from the actual sign. On the ticket he put the wrong address I told him (828 instead of 820), in the location section he switched intersection with the road I was traveling on so it says Direction of Travel: E, On: Smith Street, At intersection with: Prospect AV, when I was traveling on Prospect and passed Smith. As well I asked to see the radar gun he said yes and brought me back and then said the gun had turned off. He said he would note that on the ticket.

    My question is the chance I can get it thrown out due to the mistakes, it is a 235 ticket with 2 points if I pay now and 260 with 4 points if I go to court and lose.

    Also my radar detector never went off when I passed him so I don't know if he actually got a reading.

    You'll want to be sure the court has your correct address in case they mail you something.

    Was the speed limit different on Smith? If you wouldn't have been speeding on Smith, then that's something you can work with.

    The tiny clerical error in the address gets you nowhere. Your best bet with the misidentified street is if the speed limit was higher on the 'incorrect' street. These are not errors of the sort I would expect to cause a dismissal, let alone an outcome that would prevent the officer from refiling with a corrected ticket.

    You don't deny speeding. But if you truly think it will help, you are free to tell the judge about your radar detector at the hearing on your ticket. Somehow I think you're better off not mentioning it.

    Smith street is a 25. I'm trying to figure out what I can do to avoid such a high fine. It is 235 and 2 points if I pay in the mail, 270 and 4 points if found guilty. I don't want to go to court if i'll recieve 4 points.
