    Default Breaking My Lease to Get Away from Crazy and Potentially Dangerous Roommate

    My question involves landlord-tenant law in the State of: Louisiana

    Landlord agreed to let me off lease and return my deposit, after my roommate brandished a weapon during an argument. I filed a police report, which lead to the state filing criminal charges and a warrant for his arrest.*

    The owner and property manager was sympathetic and agreed to let me off the lease and return my deposit.*

    It's been three weeks and I can't get anyone to call me back or estimate when it will be returned.*

    I can list out all the details of my roommates the egregious behavior (theft, insurance fraud, violent crimes, to name a few) if necessary.*And what happened on and leading up to the Jan 9th departure.

    Can they change their minds about returning my money? If they had told me I'd forfeit my deposit, I wouldn't have moved out but instead filed a Order of Protection and have him evicted.*

    The crazy roommate told me I'm not getting it back and that the owner told him my deposit would go towards February rent if he didn't have a roommate by then. I've interviewed a few prospective tenants and forwarded their contact info and brief description of their personalities. I got a nasty reply about being desperate for my $$$, that I had no say in choosing his new roommate, he'll take as long as he wants to find someone, along with two pages of condescending tone and personal attacks.

    I'm at a loss as to what my rights and responsibilities are at this point.

    I just want my money back!!

    Why are you trying to find new roommates? Why do you believe that's your responsibility? (I expect, if you are in fact forwarding names of interested parties, you are not telling the prospective roommates about the weapon or criminal charge, as otherwise they would not be interested.) Is your release by the landlord conditioned upon a new roommate's taking your spot on the lease?
