    I'm curious why the initial poster is asking about this.

    The chances that he is going to be in the same room, with his gun, as a man who is raping a woman, and the man continues to rape the woman while the guy with a gun is standing there, AND the hero with the gun knows for sure that it's a rape situation AND the woman doesn't start strongly fighting back because she knows she is now backed by the hero with the gun ... are pretty small. Also, there is a difference between defending someone else ... and retaliation.

    There are also cases in which women having consensual sex have said that it was rape because they were caught at it and didn't want to look bad/adulterous. It comes out later in the wash. So you have to be very sure of what is really happening if you want to shoot first and ask questions later.

    Your dismissal of the idea of the situation is exactly why I asked. Of course 99.9% of the time it would either be an adulterous act, or he would stop and either come at the gun holder or put his hands up. But it is the unusual nature of the situation I want to know about.

    It happens. And what if there are two guys? or three? And I will say it again, I am looking for case law, those statutes don't seem to mean diddly squat in the courts eyes.

    Edit: And just because it is a safe neaghborhood doesn't mean a thing. There are gang stories out there that are horrific, and the guys ordered to do these things or trying to dominate seem to not want to stop for anything.

    You're going to have trouble finding case law for your narrowly defined situation because cases are usually only published (and they only have some value as a precedent) if they are appealed. Criminal convictions that were never appealed and plea bargains and the like won't be published. You might be able to find newspaper stories and then ask the relevant court for the case file.

    I read an article years ago in a newspaper about a vaguely similar situation but it turned out later that the woman was voluntarily having sex with a guy and suddenly cried rape when the boyfriend unexpectedly caught them.
