    Default Break Lease After Owner Declines Check

    Dropped of a signed lease and check for rent/sec deposit to move into a house in Illinois on feburary first. The check was postdated for feb 1st and now the owner wants a cashiers check instead but is holding onto the check to hold the house. Im supposed to drop of the cashiers check to get the key feb 1st which is just in a few days. I just saw another house I like better, if I can get into that house I might want to go for that instead. Since the check was never cashed can I just go in and ask for my check back and request for the lease to be ripped up? Im sure its frowned upon to break a lease but Im not really happy that I went through the trouble to bring the lease and check like I was originally supposed to, and now because of work schedule/location its going to be a great hassle to get a cashiers check during the week and get it to the owner.

    Since the check was never cashed can I just go in and ask for my check back and request for the lease to be ripped up?
    you can ask and the LL would be in the right if he refuses to comply with your request. Your contract was enforceable the moment you signed it.
