    Default Naturalization and the Passing of the Sponsor

    My husband recently passed away very suddenly of a massive heart attack. We knew that I could apply for my Naturalization/Citizenship after 3 years of marriage, but decided to wait until this year to apply. I'm devastated by my husband's passing and need some guidance on filing my N400 on my own. There seems to be conflicting information online regarding a sponsoring spouse's death. Technically I AM still married to my spouse although he passed away. We were living together for the past 4 years up until the day of his passing. Do I still qualify to apply for my citizenship as the spouse of US Citizen?? I'd appreciate any help or suggestions. Thanks!

    I assume (as Doggy asked) that you have a regular (not conditional) green card at this point since you were married for four years (a conditional card should have been converted by now).

    Reading the statute it would appear if you resided here for three years while he was alive, and you continued to reside here after his death, you can file for your naturalization NOW.
