    Default Do-It-Yourself Judgment Collection

    My question involves collection proceedings in the State of: Tennessee

    I have been awarded a default judgement of over $1000 against a renter that owes me money as a landlord. A collections attorney told me if I use him he will take a third of every dollar he collects.

    Since I already know the bank account number and where she works, would I be able to pursue wage garnishment and transfer money from their bank account on my own or do I have to use an attorney for that?

    I.e. what is involved in wage garnishment and do I have to use an attorney for that?

    If you want to seek a court order for garnishment, file an appropriate motion in the court where you won your judgment. If the process of doing that seems too difficult to handle alone, you will want to consider using a lawyer or going back to the collection agency.

    We could research this for Tenn., but your clerk should know what's next. Here, our clerk can issue (sign) a writ of attachment or a writ of garnishment. She can also provide the form. If I had a judgment, that's all it would take.

    As already said, your state may require a motion for the garnishment to be signed by a judge.

    See your clerk. This is a procedural, not legal issue which the clerk should answer.
