    Default Possession of THC

    My question involves criminal law for the state of: Wisconsin

    Hi, the other day I was a passenger in a car that was pulled over for by a Wisconsin State Trooper (in Kenosha County) and he must of smelled marijuana in the car because a k9 unit was called before we even knew what was going on. I willfully gave up my less then a gram of marijuana and was arrested. I was put in the back of his car and gave him all my information, less than an hour later I was uncuffed and released with a 100$ ticket for "possession of THC". It also says I have a mandatory court appearance with the state statute number 961.41(3g)(e). This is my first time offense and I'm worried that there is more to this ticket then the 100$ deposit. Is this case dealt as a criminal or civil case based on the fact that it was a state trooper? And do I need a lawyer for my mandatory court appearance?

    (e) Tetrahydrocannabinols. If a person possesses or attempts to possess tetrahydrocannabinols included under s. 961.14 (4) (t), or a controlled substance analog of tetrahydrocannabinols, the person may be fined not more than $1,000 or imprisoned for not more than 6 months or both upon a first conviction and is guilty of a Class I felony for a 2nd or subsequent offense. For purposes of this paragraph, an offense is considered a 2nd or subsequent offense if, prior to the offender's conviction of the offense, the offender has at any time been convicted of any felony or misdemeanor under this chapter or under any statute of the United States or of any state relating to controlled substances, controlled substance analogs, narcotic drugs, marijuana, or depressant, stimulant, or hallucinogenic drugs.
    I expect your court appearance is for an arraignment - but you need to look at your notice to appear and tell us. I suggest consulting a local lawyer about whether your county had drug deferral or diversion programs available, and if you qualify.
