    Default Vendor Hiring Consultant Employee

    We have a consutlitng engagement with a large employer. There is not a non-solicitation clause in our contract. The client has come to me and said they would liike to hire one of our consutlants. Is there a standard practice or payment for this ability to hire a consultant? I realize without the non-solicitation clause I am not in the best negotiating position, but the client has been straight with me and wants to work out an arrangement.

    Most employment agencies charge clients between 15% and 20% of the about-to-become-the-clients'-employees' annual salary (as offered by the client to your employee). Your situation is so similar to the employment agency situation I reco you just follow that practice.

    However, this is not legal advice. Legally, you are free to do whatever you want, from charging the client nothing at all to suing the client for breach of contract, and everything in between.
