    Exclamation Get a 21 Year Old Off Sex Offender Registry

    My question involves criminal law for the state of: New York State.

    I am asking for a family member of mine.
    At the age of 18, my friend started dating his 14 year old girlfriend(my cousin). When he turned 19, a girl "stalked" him. When the 14 year old girl threatened the other girl, she proceeded to lie and say the 19 year old and the girl had sex. She would be 15 at the time. He was so scared that he took a plea. He served 4 months in jail and is now a level 2 sex offender. After he was sent to jail, the girl called the girlfriend, and the girlfriend asked her questions. She asked the girl about body marks/tattoos/scars, and she got every question wrong. It was also discovered later that he was with the girlfriend during the times of the alleged sexual acts. The other girl lied, and he was the 5th boy she's done it to.
    About a week before he was arrested, he and his 14 year old girlfriend had sex for the first time. (Both their first time) The police questioned the girl, and threatened her. They told her that they had proof of the sexual act, and that she would be taken away from her family. She then admitted to what the police told her had happened, and he served 1 year in jail. He is still a level 2 sex offender.
    Being that the charges were brought up when he was 19, he hoped to have it taken off when he was 21. He isn't very hopeful because of 2 charges, but everyone is trying to help him. This is ruining his life. He had plans to go into the air force, but now he can't because of this.
    Any help would be greatly appreciated.

    They do not expunge sex offender charges usually. By your own admission, he did break the law. He will likely repeat the act, statistically (I believe), given the chance.

    Realistically, it ended there. He stood before a judge and admitted to the crime of which he was convicted. Ha could have taken the case to trial, and let his attorney expose any problems in the victim's statement - but he didn't. His time limit to appeal a conviction in NY was 30 days . After two years, this is a done deal.

    I agree + Nobody admits to a rape they did not do. Nobody. Especially a 14 yr old. He is going to be a sex offender for a long long time.

    aardvarc is right. Unfortunately I've heard from many people in the same situations as the OP.
    Especially with the sex crime laws, it does not seem as if they will become any more relaxed. How long is he supposed to be on the registry? I've had many clients who were supposed to be on the registry for only a limited number of years, but due to some law changes they are now on it for life. There is usually nothing we can do to change this.
