    Default Notice Period During Visa Transition

    hi my name is Naveen , I was a full time employee of the company A , And i was working for the client C based in torrance california , My scenario is i came as a L1b visa and after working for A i have switched to h1b and i have given 2 weeks notice to A and then left to my new job with company B , but A says that they will not take the 2 weeks notice and would be considering as absconding and is not providing me the reliving letters or experience letter and also not gave my settlement salary , wanted to check with you if the 2 weeks notice is necessary or not as A says to me that i need to provide 2 months notice.please let me know any helpful thoughts.

    You may have signed a contract regarding them having paid your expenses to come work in the US. We don't have that information. They are not required to give you a reference. You don't get severance salary for quitting. You sometimes get it for being laid off or terminated.

    There is no US law governing notice when leaving a job. However, you likely have a contract with A that can be enforced; you may be liable for "damages" to A if you have not complied with the terms of your contract. Two months notice can certainly be a requirement of the contract. Take all of your employment documents from A to an attorney for a review.
