My question involves labor and employment law for the state of: Michigan
I have a complicated question so here goes-
First off let me set this up with some background information0 about 7 years in 2004/2005. I was caught with a half of a smoked cannabis joint in my pocket in my college dorm room. I was NOT ARRESTED on the spot, instead, a week later, the police called me to let me know they issued a warrant and I went down to the station to turn myself in. I was booked ( fingerprints, mug shots, etc etc). FYI- The charge was USE OF MARIJUANA which in Michigan is a lighter charge than POSSESSION ( kinda stupid, but hey)
Michigan has legislation that is referred to by us in state as a 7411 referring to http://www.legislature.mi.gov/%28S%2...e=mcl-333-7411
Basically, if you complete probation and whatever else the court orders, your conviction is deferred and the case is DISMISSED. I completed these terms, so techincally I don't have a conviction. I have since graduated with my B.B.A in marketing and started a career in advertising. I don't think the small business I worked for did a background check and I have worked for them up until a month ago, since college. So I have not really had any big corporations or government jobs run a background check on me, so I really don't know what a potential employer sees.
Here is my question/scenario- I have recently been researching very heavily into teaching English overseas ( South Korea, Thailand). Which brings in the whole equation of obtaining a WORK VISA for each respective country. Thailand is pretty relaxed. However, South Korea is very strict and requires a CBC from the FBI in order to obtain a work visa. Any mark on my record is auto-deny these days for work visas in South Korea.
What will show up on the FBI's CBC (Criminal Background Check) database? Will they see my "arrest" records? I wasn't actually arrested or read rights, I turned myself in.
This goes well beyond applying for a job in America and the whole " do I have to disclose my conviction/arrest on an application"
Thailand accepts local/state CBCs which should come up clean, but the FBI/National CBC will probably show my dispostion/"arrest"/ dismissal?
Thanks in advance to all who can help, especially you Michigan Attorneys!
I don't know if this matters at all, but just FYI- I am current a registered Michigan Medical Marijuana patient. I have never been arrested or convicted of ANY other crime other than the USE OF MARIJUANA
Also- beyond VISAs... how would this affect my future career applying for corporate jobs, especially bigger corps, in America? Do most big national/multi national corps do FEDERAL or state or some other type of Criminal Background Check
