    Default Can Agency That Placed Exchange Student Prorate Stipend when Student Travels

    An agency has placed a foreign exchange student in my home and is now trying to prorate my stipend during the time that the student is traveling, 26 days. The students possessions are still in the room. Another host family has told me that they can't do this? Before I go to them, I want to make sure that I know what the law says. Thanks.

    It is not about the law. It is about your contract. What does it say? If this is a high school exchange student, your motives and intentions are completely off base. This is not about making money, it is about expanding the child's horizons. The stipend is to cover food, utilities, etc.. None of which you are incurring while they travel. What state are you in?

    Concur with T53147. This is a matter of contract, not a matter of law.

    Generally, agencies that provide host families with a stipend do pro-rate when the student is not actually in residence. "In residence" means physically there, availing himself of utilities, food, etc. His possessions merely being in the room do not constitute the student being in residence. If the student is not using resources, why should you continue to receive the same stipend as if he was?
