    Default What is the Punishment for Drug Paraphernalia

    My question involves criminal law for the state of: Texas
    My boyfriend and I got pulled over last night because his license plate light was out, and he saw the cop and turned into a neighborhood but he followed us, and he searched the car, in which there were two grinders, two grams of marijuana, and a pipe. He gave us each a citation for possession of drug paraphernalia, and we have 20 days to show up in court.

    What's the usual punishment for that? He needs his license to get to work, and I really don't want this on my record. We can both pay a ticket. We're both 18.

    ANY drug possession conviction in TX automatically results in a suspended driver license for 6 months.

    Did you mean 2 OUNCES? (Texas law addresses marijuana possession in terms of ounces, not grams).

    If it was 2 ounces, that makes it a Class B Misdemeanor, punishable by not more than 180 days in jail and a fine of not more than $2,000, plus the automatic DL suspension. The possession of paraphernalia will be a separate charges with additional potential jail time and/or fines.


    If he needs his license to work, then he needs to not be engaging in criminal activity that can cost him his license. It's really that simple.

    It sounds like the cop already gave you a break by only citing you for paraphernalia (rather than booking your for marijuana possession AND paraphernalia). As far as punishment, no one here can really answer that question because nobody here knows you or your bf's criminal history or how harsh the prosecutor and judge in your case deals with this type of offense.

    And, I have to add...no, your bf really doesn't need a driver's license to get to work and that statement just might piss off the judge just as much as it does me. He can have a family member or friend drive him or he can arrange to car pool with a coworker. If none of those options are available to him, it is probably because he is a friend of Beavis that has no family members, friends, or coworkers who think enough of him to help out (and, as his gf, you might want to give that a lot of thought). If none of those options are not available, he can take a bus or taxi. Maybe he has to leave 2 hours before work to get there on time or has to budget his income to include taxi fare...maybe it isn't convenient, maybe its embarrassing, maybe it severely cuts into his weed money...but he does not NEED a license.
