20 years ago my husband started drawing his pension and has since divorced the woman he was married to at the time of retirement.In trying to get his financial papers in order he requested his pension after he dies go to his present wife (me)-he has also taken less pension to provide for his present wife. He has been told that his present wife he is now married to is not considered a "qualified spouse" as she was not the woman to whom he was married when he started drawing his pension. What is the definition of a "qualified spouse" in a pension plan? What recourse does he have to ensure his present wife is taken care of?
