    Question Is Failing to Reveal Sexual History to One's Sex Partner Rape

    My question involves criminal law for the state of: Just in a general scenario in the United States.

    The scenario is a male-to-female woman who has consensual sex with a man, and then reveals that she was previously a man. Is this considered rape? If not, then what and why? Thanks.

    It is considered stupidity on the part of the male for sleeping with someone he doesn't know. Legally, the person having a sex change has done nothing wrong in your description.

    No, that is not rape.

    There are no laws saying that one must reveal one's birth gender to a potential partner.

    it wouldn't be rape if s/he was still a man. Consensual sex is the opposite of rape and you did say it was consensual sex.
