    Default Mother Not Allowed to See Children After Leaving Due to Domestic Violence

    My question involves a child custody case from the State of: Tennessee
    I am a mother of two and me and my husband have been seperated for couple months. I left due to domestic violence and had to leave my kids with him. He wont let me see them or talk to them. What are my options to be able to see my kids till I am able to get a divorce which will be sometime next month. He was on probation in Alabama due to pulling a gun put on my brother and last time we seperated I put a warrant out on him as well for domestic violence but Alabama police wont do anything with him up here would any of that have any effect on me tryin to get my kids now? Thanks

    You can file for temporary visitation/custody, or legally you can simply go and pick up the kids.

    However - and you were advised this elsewhere I believe - I would think very carefully about the latter if there are allegations of domestic violence. And again, are you in touch with a DV shelter? Where have you been staying?

    I have not spoken with anyone yet I dont have the money yet for an attorney. I did not want to leave my kids with him but the way him and his family are they would not allow mw to take them. (He lives with his parents) My boys are 5 and 3 and that day my 3 year old was even hitting me and telling me to leave because he see what his daddy does. That broke my heart. I try to talk to them he wont let me he wont answer my phone calls or my text messages. On Christmas he told me I had the wrong number. It all breaks my heart but I can no longer live in an abusive relationship and he's a drug addict always been. I just finally got strong enough to leave. How do I go file for temporary? All of this is new to me, never been through it Im 25 and have been with him the past 6 years.

    I cannot stress enough how much you might benefit from contacting your local domestic violence shelter. They have numerous resources that may help you deal with your situation, not the least of which is an ability to guide you through the process of reuniting with your children. They may even have programs that help you to establish legal protection for you and your children as well as locate housing for all of you. They are definetely worth the phone call first thing Monday morning.

    What are you trying to accomplish? You left. You started this thread asking about visitation, then finished wanting custody. Are you looking for CS to pay your rent or welfare out of this?
