    Default B-1 Cancellation

    Hi Sir,

    Need your help in understanding the cause and impact of my B1 visa cancellation.

    I have more than 8 years of IT experience, and I have travelled to US twice (on B-1)few years back from my previous employer.
    My first visit was for 3 months, and second visit was for 5 months (I-94 was provided for 6 months). I stayed around 7.5 months in US during that year. This stay was for a world leader Bank client, and required to understand and study the business requirements, knowledge transfer from the clients and end users from multiple geographies. This was a very highly ambitious multimillion dollar project for which I stayed for months in US on B-1.

    Recently, I applied for L1B from my current employer, it was submitted for few specialized knowledge in few propriety tools. But during the very start of the discussion, VO told me that I have abused B-1 visa for my earlier visits. I tried explaining him, but he was not convinced. He rejected by L1-B. But to my shock, once I checked my passport at home, my B-1 was also CANCELLED (which was valid for few more years), I feel on the ground of B-1 visa visits.

    Would like to know how this cancellation of my B-1 and rejection of L1B will impact me in future, if I would apply for H1B or L1 individual.

    Your suspected abuse is certainly going to affect future visa processing. It is possible that the activities that you performed under B-1 were believed to be inappropriate for that visa category as some employers send employees on B-1 when L1 (or H-1B) is required. Presence for 7.5 months is not a temporary assignment for the type of activities normally performed on B-1.

    Your employer should arrange a consultation with a US immigration attorney for you if he wishes to continue the L-1B process. Otherwise, you should consult one before applying for other positions requiring a US visa. It would be unprofessional for you to apply for a job requiring an H-1B approval by an employer (an expensive process) knowing that you have this problem with your US visa applications. The attorney can advise you the best way to proceed.
