    Default CIS File Issue and Adjustment of Status

    Hello! I have some concerns and looking for answer, so here it goes

    This case is in Seattle, Washington.

    I have an approved I360 based on WAVA while I was in removal proceedings. I have gone through master calendar hearing and government attorney didn't have my file, but Judge proceeded to assign individual date, so went for that, and govt attorney did not have my file once again, my I360 was approved in Nov 2005 and individual hearing was in July 06. Govt attorney said you can’t have decision for adjustment of status since he doesn’t have file, what they did they terminated my removal proceedings without presides so that I can seek Adjustment of status administratively.

    Now how long does it take? My representative said he has sent email to local USCIS so that they can schedule interview for Adjustment of status. But what I am looking for is how long does it take? I can’t understand how comes govt attorney didn’t have my file from Vermont while it was done 8 months ago. Is there anything I can do to expedite it or make sure everything is being done? Most important, can I travel in this situation?

    I have no way of determining what happened to your file or when it would become available, nor why the government lawyer's inability to find his own file would prevent the court from taking action.

    Travel would seem risky - last I checked there was no provision for advance parole in VAWA U Visa cases. I would suggest consulting an immigration lawyer, and refraining from international travel until after you have the consultation.

    Thank you very much for your reply. I appreciate it.

    Govt lawyer said that day even if judge grant the decision, he will not be able to enter final order until file is available, either you can have another date for 9 months and still no gurantee if vermont releases file or not OR terminate proceedings and ask USCIS to adjust status administratively.

    I am in the middle of ocean trying to figure out if there is anything that can be done to expedite it.

    Would you know, when person can file adjustment of status if married to LPR(green card holder) under VAWA?
