Seriously....while I wish they would just legalize the stuff (and tax it like alcohol and tobacco, and make it quality controlled, and you have to buy it in a store instead of from a drug dealer, etc,)....the FACT remains that marijuana is illegal. Therefore, when you purchase it, possess it, use it, you are breaking the law. No matter how unjust you feel the law is.
Don't like the law? Write your elected officials. Beg them to make Marijuana legal. State your points in a well thought manner. Why should they legalize it, etc.
Oh...as to the signs of being high....it goes beyond cotton mouth and bloodshot eyes. Think about it....ever notice how a person who smokes tobacco SMELLS like tobacco? How you know your co-worker smokes because they smell like it? Guess what....the same applies to marijuana....That smell lingers on you, your clothes, your hair, your furniture, your car....The cops are not as stupid as you think.
it is not illegal to be under the influence of marijuana in most states, only to possess it; however, in some states having thc in your system is considered possession. as for a DUI, if you deny being under the influence you cannot get a DUI.a warrant or probable cause is needed in order for them to aquire your blood, urine, or other DNA such as a mouth swab. whether you looking and smelling high is probable cause, i do not know, but i would refuse to submit DNA and if they have the right they will just take it without consent. furthermore, i don't know that thc presence in your blood or urine proves that you were under the influence AT THE TIME of your traffic stop or however you were detained. you could inform your lawyer to notify the court that you had used the previous day.bottom line is deny, deny deny

there is no citation to cite here simply because there is no statute prohibiting the presence of THC in one's system. there are, however, laws prohibiting the possession of marijuana. my point being that sometimes there are no laws prohibiting something therefore indirectly making it legal. there is no statute which one can cite that says "it is legal to be under the influence of marijuana"
A better suggestion would be "[citation needed] to backup the claim that presence of THC in one's system has criminal consequences" because i can't prove that a citation does not exist--negatives cannot be proven.

who is trying to make things up and what are they trying to make up? this citation is only in regards to public places.on private property there is no law against being under the influence unless operating a motor vehicle.
it also clearly states that you must not only be under the influence but in addition, you must be unable to exercise care for yourself or others or obstructing the free use of a public way. i'm asking for anybody who can produce a citation that the mere influence of marijuana without the additional acts or behavior is a criminal offense
since you've failed to answer my question as to what i've "made up," it seems as though you've realized that it was not only a false accusation but that you've provided an invalid citation to try to make yourself look like the "mr.knowitall" that you see yourself to be. 53,000 posts does not make you right; "I am human and I will be wrong some of the time." ---i belive you nailed this one. so if you want to add further conditions of conduct and make factors up about my statement, find a different board. there is no law in most states against intoxication of marijuana by an orderly person, in public or private, if they are not operationg a vehicle.
