    Default Sale of Car to Minor

    My question involves a consumer law issue in the State of: Wisconsin

    So my son sold a car on craigs list 2 weeks ago to a 16 year old. He did a bill of sale at that time. Now 2 weeks later they want my son to take the car back, and of course my son doesn't have the money. So I understand that a 16 year old can't legally sign something like that.

    So if they sue, I assume it would be in small claims court and they would win. How does the court go about gettin the money? Garnishment? Will that show on his credit report?

    Your son signed the title over to this minor, and then what? Was the vehicle registered in the minor's name or not? Was it registered in a parent's name instead? Was it registered at all? How many miles were placed on the car after the sale and before the return?

    If you don't pay a judgment that has been secured against you, that goes on your credit report as a significant negative entry.

    If your son has the car back, why doesn't he sell it again - this time to a grown-up? He can then reimburse the minor.

    Well my son never titled it, but transfered the title over. Guess that was illegal.

    My son went to meet the kid at the DMV to get the title straightened out, and the kids dad was there. Threatening to sue.

    No miles were placed on the car, as something is wrong with the transmission, which the kid new as they trailered it home.

    He doesn't have the car back. The issue is he doesn't have the $2,500 to give back.

    Maybe he can borrow the money from his mom and dad, to be repaid when he sells the car to a grown-up.

    I mean I don't know how they expect you to get to work if I don't have enough gas to get there.
    Dad can't even afford the gas for work evidently.

    Indeed it is. The son have had a title he could transfer; therefore, the sale can easily be voided.

    Up to you as to what you want to do. You could be sued successfully.

    More like, junior could be sued. Unless junior is a minor, it's not yet apparent that mom and dad could be dragged into a lawsuit.

    No, he's not a minor, so we have no involvement. If I had the money to lend him I would, but we will be filing a chapter 13 in April, so not an option.

    Thats never had a title he could transfer.... voice programs errrr
