My question involves a marriage in the state of:Tennessee.
My husband abandoned my son and I almost 2 years ago. My son was born inside of our marriage however is NOT biologically my husbands. My husband has known this since the say I told him I was pregnant and we got back together after a break up then got married in the following February and my son was born that July. Being inside the marriage my husband signed the birth certificate. I asked him if we could leave his name off but he said he would divorce me if I didn't let him put his name on there and being 19, in school, and scared of being a single mom I let him put his name on there and we went on with life as if my son was his. Well he hasn't had anything to do with either of us for almost 2 years and I would LOVE to get on with my life. Would he be able to file married with no children since my son is not biologically his or would he have to file married with children and be stuck paying child support and having visitation orders (not that he'd even see him)? How would he file for a paternity test to disestablish paternity? Would he then be allowed to file married with no children? BTW I do not know who my sons biological father is. I was in a party phase of college and quite reckless.
