    Post Living in a Hotel Because of Eviction

    My question involves an eviction in the state of: CALIFORNIA


    My question is that I lived at my last place for 4mos and I was late paying my rent and recieved the 3 day notice but they attached the "late fee" notice to the 3 day notice and said that since the 6th fell on a Saturday the late fee would follow on the 5th which confused me because the office is open 7 days a week but when I went to pay my rent on the following monday the office was already closed when I got home from work and there is no drop box or anything and the managers would not allow tenants to drop off rent at their personal apts so I had to wait until the following day and as I wrote out the money order, the mgr said he didnt think he could take my payment because it was late even though it was dated within that 3day and I even added the late fee, he called the owner and he apparantely said he wouldnt take it so the mgr gave me a sticky with the lawyers phone # so i called and the recording said i had to talk through email so i emailed, the "assistant" of the attorney said that if i wanted to stay i had to come up with $2400 within 3 days and the day after i contacted her i got served papers! i tried to get legal help on wat to do and one gentlemen said to fight it and file my answer and speak with the legal aids at the court house so i did and the ladies said that the 3 day notice was inconclusive because they attatched the late fee with the original notice and they informed me that the attorney i would meet up with would work with me as far as payment arrangements, i went to court and met up with their attorney and he gave me 2 weeks to be out and even though i wanted to fight it he said that i would still lose and would have to pay over $3,000! I contacted the attorney that helped me before and explained the situation and he said he knew their attorney and that he would talk with him and get the copy of the agreement and make sure it wouldnt be on my record.....i just found out last week that it is now on my record and now my children and i are staying in a motel room for now until i can find someone that will take a chance and rent out to me How can i fix this? Someone didnt do their job and now im screwed and all i want to do is give my kids our own place! we lived with my mom for a couple mos but she moved out of state...please help! any advice would be much appreciated!!!

    We weren't in court with you, and you haven't told us what your agreement was. It sounds like you agreed, in court, to the entry of a consent judgment. Is that in fact what you agreed?

    Yes I did sign the agreement but I never got a copy of it from that attorney and I found a website that specializes in helping tenants so i sent them an email about my situation and they responded saying I fell into their trap and to contact them asap so i did and spoke with a "robert" and he informed me that he knew their attorney well and asked for all the paperwork so i emailed it all to him except the agreement because i didn't have it...i moved out way before the lockout date and informed this robert that i moved out and that i didnt want this on my record and he said he would contact the attorney i signed the agreement with to get a copy and stop the lockout....i never heard from him again and now its on my record
