    Are you are an investigator with child protective services and that is your professional opinion to the court? If not, means nothing.

    could the mother move out for the sake of keeping her child away from the danger and violence of the household?
    No. She can't. What she CAN do is call the police should violence occur in her home. If her living environment is determined to be dangerous or violent, she will be removed by the state and THEY will determine where she'll live.

    The bottom line is that she is NOT living with you unless her parents bless that happening. Even if.

    When she called the police to report violence in her household, what happened? When she called CPS, what was the outcome of the investigation?

    I dont have to be an investigator to know that a household where the moms boyfriend hits her kids isn't good for the baby to see.

    As far as the courts are concerned, if there's no police and/or CPS involvement, it never happened.

    You're not going to like this, but I'll say it anyway, because it's not my job to make you like correct answers: You are legally NO ONE in this situation. If your friend is in a dangerous environment, you call CPS and the police. But that's all you can do. You can argue with whomever you like until your face falls off, it will not change the legal reality of the situation.

    For the record, emancipation is not granted because of the conditions of the minor's home life. On the very, very rare occasions that it is granted, it is granted on the basis of the minor having a proven track record of having better than average maturity and of supporting themself entirely. Your friend fails on both counts.
