My question involves a marriage in the state of: South Carolina
I need some advice.
I was married for about 6 months. We separated about 4 months ago and we have written and signed a separation agreement that has been notarized. We no longer have joint accounts, joint debt or anything. We have no children together. We have amicably decided on the division of property as well. South Carolina (from what I understand) does not recognize legal separation. We are filing as uncontested, no fault, pro se, so I will submit the paperwork in about 8 more months (One year required separation).
The problem is I’m pregnant with another man’s child. I just found out very recently. The baby is tentatively due before my divorce would/could be final.
I had some questions in regards to my situation:
Can the father of my child sign the birth certificate if the baby is born before my divorce is final?
Is the baby considered my husband’s legally since it was born before my divorce is final?
If my husband decides to file for adultery, would the judge allow a divorce before the baby is born, or do we have to wait until I can prove paternity?
Are there any criminal repercussions to my situation as it relates to me? I.e. can I go to jail or get fined?
Do you have any other advice for how I should approach this situation?
As crazy as it sounds, I have heard of those being able to seek a divorce from another state depending on residency requirements and have entertained the idea of going to Guam for 7 days. Does anyone have any advice or insight to this as well?
