    Default False No Contact Order

    My question involves defamation in the state of: North Carolina

    Well, I am going to try to give you some background information and make it short and to the point because it is a long story. I moved to North Carolina in February 2011 and my family stayed with my mother in law until we found a home of our own. In May of 2011 we moved into our own home and from that day began having issues with my neighbor! It started out with simple pettiness like, your kids bike tire is on my side of the property, etc. It then spiraled out of control. My daughters bus stop is at the top of our street near a stop sign that is in front of this woman's home so every morning and afternoon, I need to pick my daughter up there. Se then started complaining about my and my son and my dog being "on her property," which we were not, we were simply waiting at the bus stop, many other mothers are with me as well. SO for 6 months I have been dealing with this and her calling the sheriff on petty crap and starting to involve my children. Finally on December 14, I was waiting at the bus stop in the afternoon with my son, my dog, and another mother, when she came out on her porch claiming that my dog and child were on her property and need to get my "heathen kid and piece of crap dog" away from her property! I finally had enough, especially once she went after my child and called him names and I told her that if she had a problem with me to bring her butt down off of er porch and talk to me face to face. She told me I needed to watch my tone of voice and I flip out, who is she to tell me to watch my tone of voice with her, I am 31 years old!. So anyway she sent her son, after me, who is 17 by the way. Words were exchanged from all of us, mean while there were witness standing right next to me. So she ended up calling the sheriff and needless to say nothing was done, they just asked my side of the story, went to speak with the witnesses and then went back to her home. So on December 15th at 9:00 at night I got served with a no contact order and a misdemeanor criminal summons. Now the no contact order has absolutely false information and states nothing that happened on the day in question, reminding you I have witnesses. The criminal misdemeanor summons is due to me communicating threats to her stating I was going to kick her a$$. Yes, I did say that, but only after her and her son threatened to put their hands on me. so now I have this no contact order on me from her and her son and to top it all off, I can not even go shopping in my local market due to her son working there, that makes me have to drive almost 50 minutes to the next store!!!!! I need some advice regarding a no contact order!!! I have to go to court on the 20th of December which is this Tuesday so any information would be greatly appreciated!

    You threatened physical harm... in a couple of ways.

    I can see you having a difficult day. You way you are 31 years old but are yelling threats at another adult across a yard.

    This is not what adults do. If I were you, I would prepare for the no contact order being continued for, at least, a short period of time. Make sure that you mention where the bus stop is so that someone OTHER than you can wait for your child there.
