    Default Evicting My Ex Wife

    My question involves an eviction in the state of: Texas

    About 3 weeks ago, I allowed my ex wife to stay in my house where I am the only lease holder after she was evicted. Since then she has brought people in my house that have stolen checks from me and pretty much worn out her welcome. I aske her to leave, but she refuses and says I have to evict her to get her to leave. Is this true? If so, what grounds do I put on the eviction notice the I file with the court?

    Exactly what do you mean by "I allowed my ex wife to stay"? Did you charge her rent? Did she change her mail address or driver's license to your house?

    Exactly what do you mean by "after she was evicted"? Your landlord evicted her, but not you? How long ago? And you let her move back anyway? Without your landlord's knowledge?

    It was just temporarily. She hasnt been hear a month. It was for her to get on her feet. She has not changed her license or her mailing address to my knowledge.

    She was living somewhere else and got evicted about 3 weeks ago.

    As it stands, if she refuses to leave you can talk to the police about having her removed as a trespasser. I suspect, though, that when they hear that this is your ex- they will tell you that it's a civil matter and you have to evict her - but you won't know that until you ask. (If it needs to be said, this is not an emergency and thus you would not call 911, you would use a non-emergency number or go into the station in person.

    If the police were smart, they would tell her to move along. Nobody likes to get in the middle of domestic disputes and the cops know if they just say "its a civil matter" they'll be back and the situation may not be so pleasant. So they may have her go.

    There should be a separate # for domestic disputes: 666? or..
