    Angry Doctor Prescribes Medicine Despite Patient's Allergy

    My question involves medical malpractice in the state of: tn
    My Fiance' went to the er and for a fractured foot and and his tooth was hurting they prescribed him penicillin and it clearly said in his file that he is allergic to it. The nurse and the dr both said so i see you are allergic to penicillin and of course he said yes so after being discharged he goes to fill script and after he gets home goes to them and he was lucky he looked at the label because it was penicillin of course he calls the er and they tell him theres nothing they can do he already filled it they cant change it now hes tells them what happen and they just dont seem to care that it could have killed him the last time he took it he couldnt breathe and swelled up and had to stay in the hospital for a week.. Anything we can do we even the discharge papers. thank you

    Go to a doctor to get something else prescribed. There was no damage here. He was aware of the mistake and did not take any.

    The only thing you can do is wake up tomorrow morning and find another doctor that can write a script that your fiance isn't allergic too and will help with the condition that your fiance is experiencing.

    If you think that you could sue and recover some type of money, then you are wrong. See another doctor in the morning for a different script.
    I'm not a lawyer, but I did stay at a Holiday Inn Express last night.......

    He suffered no damages.

    There is no case here.

    Concur. It is the patient's responsibility to be aware of his/her medications. That includes reading the scrips to ensure they are correct, and checking again when the scrip is filled.

    The doctor writes the prescription, and the patient ultimately chooses to take it or not. Why would someone allergic to something prescribed knowingly take that medication??

    I think the Dr. who wrote a bad script should fix it just out of courtesy. Go figure huh? Go see another pill pusher!

    Certainly. And you know, I don't know any Docs that would refuse to fix it. In fact, I've been accidentally prescribed medication I'm allergic to, and when I looked at the scrip and reminded my Doc that no, can't have that, it makes me break out in hives and vomit up everything I've ever eaten in my whole life, he apologized for the error and wrote out the correct scrip.

    The issue here seems to be that rather than go back to the Doc and say "Hey, Doc, I'm allergic to this, can you fix it?", our friend just wants to run off to court.
