    Default Threatened at Meeting of Creditors

    My question involves bankruptcy in the state of: CA

    The debtor threatened me at the meeting both outside and inside the hearing room. I was not at liberty to ask questions. I wanted to ask why I was named a creditor. There is another date set, but may be cancelled if questions the Trustee has are satisfied prior to.

    I did ask the debtor why before going in the room and he answered, but I wanted him to answer in front of the Trustee.

    For me to be on Schedule F is likely abusive. He's trying to discharge wages. He disputes it as noted in the bankruptcy documents, but does not list a value or a reason. I'm not sure what I can show of this. If I'm reading the documents correctly I should be on Schedule E if applicable within any time constraints.

    Given the threats who do I go to about this? Do I report this to the US Trustee or seek legal aid first?

    If you were threatened in a courthouse and believed the threat, surely you reported it to a court officer, no?

    There's obviously a back story that you haven't shared with us.

    There was not any court officer (?), unless you are referring to the US Trustee. It was a meeting to ask the debtor questions when the debtor was sworn to answer questions to the US Trustee.

    The room held several cases all at once. As the US Trustee called each case to the table, the US Trustee sat at the head of the table, the debtor sits to one side of the US Trustee, creditors sit opposite of the debtor and the debtor's attorney sits opposite of the US Trustee. Everyone else sits in rows of chairs listening and waiting their turn.

    The importance of not reporting this yet is safety. I live under the same roof as the debtor and his threats are real. How do I protect myself when I report this? I have a letter waiting to send to the US Trustee, but safety is an issue.

    You were in a federal courthouse, and therefore there were federal law enforcement officers and court officers providing security at various locations in the building. It would have taken you all of fifteen seconds to find one. You appear to be confirming that you did not take the threat seriously, did not report it to anybody, and aren't going to share the back story... so there's not much we can say.

    If you're terrified of the person you live with, move out, seek a personal protection order, etc.

    If I was able to leave I would have a long time ago. It's very poor practice to assume a threat is not real. I refuse to give myself away here, because you assume the threats are not real. If there had been obvious federal officers about as you say there should have been I would have talked to someone.

    It was not in a federal courthouse. When I went to inspect the bankruptcy documents...that was done in a federal building with security everywhere. I was searched going in and my ID checked. This meeting was held in a conference room at a hotel.

    Do you know if the US Trustee could somehow provide a level of protection?

    If you took the threats seriously you would do something. If you wanted to leave, shelters are available to you.

    If you're asking what will happen if your partner threatens you but you never bother to tell anybody, absolutely nothing will happen. Because you refuse to tell anybody. What else could you expect?

    The trustee handles finances. He won't arrange a bodyguard.

    So we are going to play 20 questions? I assume you are a spouse or relative and the wages are from a small business? Tell us all the facts and stop playing games if you want constructive help. Why would you not be threatened in the sanctity of your own home?
