    Default Sexual Battery

    My question involves criminal law for the state of: California

    Recently someone from the City Prosecutors office visited my childs school. This person told students that if they accidently touched someone in the bathing suit area they are guilty of a sex crime(even if touching was accidental). They would be fined $2,000 and be required to register as a sex offender. This is a middle school. Sexual Battery usually involves some intent to get aroused, but kids bumping into each other?? Does this have any truth in it or is it just complete BS, because if it is I don't appreciate by child being lied to like that. Any info would be appreciated because I plan on addressing the school board and City Prosecutor if I am right. They were given a similar speech at the beginning of the year and were told they could not defend themselves against someone beating them up. That if they did attempt to defend themselves even against multiple attackers they would be in as much or more trouble than the attackers. I know that to be bogus as you have a right to defend yourself even here in California and you don't have to flee first.-David

    Casual contact a sex crime? Not able to defend yourself when attacked? What exactly kind of whack-job do they have spewing this horse crap to (impressionable!) kids?

    There oughta be a group of parents taking exception to what is going on there, not just you. Y'all need to address this at the next school board meeting. Leave the PA's office alone simply due to the fact that they are out of their flippin minds!!!

    If done on purpose, it can be charged as battery. Incidental is no crime.

    Oh, I know, it's cause I'm at work at some unusual un-Godly hour and haven't consumed coffee yet.

    I am not saying the prosecutors office was correct in how they handled this, however, a boy, brushing up against a girls pubic area, would certainly illicit a charge like sexual battery punishment in some places. Defending yourself in school, is punishable as a breach of school rules. The new method is for your child to fall to the ground with their hands cradling their head, shouting for a teacher to help them. This was all brought to you by your local anti-corporal punishment whack jobs, which comprise a growing segment of the lemmings in society.

    Thank you all for your replies, I just needed a reality check...My understanding of the law is the same as all of yours. I have been in Southern California for 2 years and you would not believe all the crap they tell kids in school here. In social sciences last semester they studied Allah and Muslims. Thank God I raised my kids right and taught them to ask questions and get facts(in a respectfull tone) when things sound out of whack. I plan on addressing the school board I am not afraid to confront them on the facts. I would like to at least write a letter to the PO on principal. I am the only parent questioning this nonsense. I don't mislead my kids and I don't expect the education system to either. My H.S age child has had about 3 run ins with the Admin here. I made her stand her ground and present her facts and she prevailed in all 3 against the teachers.
    The not defending yourself and sex offender are just the icing on the cake. You got to love the Republic of California.

    Thank you for your answer. California Public School is who spews this. I can't wait to see the faces of board members when I address them.
