    Angry How to Help My Fiancée Get Divorced

    My question involves a marriage in the state of: Separation in which the following is going on.

    1. My Fiancé and I have been living together for 6 months and she has been separated from her husband at that time
    2. They have been married for a few years and he is currently here illegally from Canada on an expired visa
    3. They have a child who has just turned 1 year old that they had while married
    4. We are on ok terms with the soon to be ex and have been having voluntary shared custody of the child
    5. He has to go back to Canada and due to the expired visa will most likely be barred from coming back anytime soon
    6. He has conceded to the fact that he can’t come back and has verbally agreed to give up rights to the child.
    7. He was not physically abusive during the marriage but he had intent to be unfaithful (online dating) and was mentally abusive at times.

    My goal is to have the divorce finalized, and the custody stuff settled so he can go back to Canada and start his life over and I can start my new life with my fiancé. While we are on good terms, this would be preferable to be as soon as possible because while we are on good terms the sooner he can go back the better.

    1. Is there any chance in hell in getting this done without a Lawyer
    2. Is there a specific type of lawyer I should seek if I need one?
    3. Can we motion for an expedited divorce given that he needs to leave the country?
    4. At this point we have no papers filed, I would like to do this as friendly and honest as I can while things are still on good terms as I feel that once the reality of everything comes to a head for him that he will become less and less willing to be cooperative. So what is my best course of action?
    5. If in theory he got deported tomorrow would we be looking at years of paperwork to prove abandonment of the marriage and have difficulty obtaining full child custody?
