    Default Adding New Child While on Chapter 13

    My question involves bankruptcy in the state of: California

    We are 16 months into our 60 month Chapter 13 case. We are expecting our second child in February, and beginning in January (when my wife takes her pregnancy leave), our finances will be much tighter.

    My question is...would adding a dependent (new child) require us to have our case re-assessed? or is this something that we should look into? Or are we permitted/not allowed to add to our family?

    An added child is cause to look at your budget with the idea of adding "allowed" expenses for the increased family size. Whether or not such justifies reducing your court payment correspondingly depends upon what your Plan is required to pay to your creditors. If there is no "wiggle room" in the Plan to reduce payments then your family size will not matter. You need to discuss this with your attorney.
