My question involves criminal law for the state of: Georgia
I live in a house with four roommates. One of the roommates was trying to get a job as a cop, so he moved out because two of the roommates smoked marijuana.
He moved out when no one was home and stole a bunch of things. He texts, me a month later asking me to pay him for my portion of the power bill. I refuse due to the items he stole being worth way more than the bill. He then texts me back threatening to go to the police and say I stole a propane tank from a local bar if I do not pay him the money. He has no legal recourse because we never had any written agreement about the power bill and the lease is separate for each individual room.
In the text he makes it very clear he will only go to the police if I don't pay him and if I do pay him he will do nothing. He also uses the exact amount he expects from me to not go to the police. I have no stolen propane tank in my possession nor have I stolen anything. Either way, even if I did I doubt he could get me in trouble as he isn't a cop yet.
On the other hand, I am fairly certain his text attempting to blackmail me is very much against the law. I found a federal law statute saying as much:
§ 873. Blackmail
Whoever, under a threat of informing, or as a consideration for not informing, against any violation of any law of the United States, demands or receives any money or other valuable thing, shall be fined under this title or imprisoned not more than one year, or both.
There may also be Georgia laws which apply.
Anyways, should I file a police report and what Georgia laws did he break?
