My question involves criminal law for the state of: Colorado
My girlfriend was in the process of wrapping up her affairs in Colorado to move in with me in South Carolina when she got a DUI. Due to money shortages and her first offense, she plead it down to a misdemeanor but now has probation and 33-40 total weeks of therapy/classes she has to attend. The issue is that she had already signed off on her lease and put in notice on her job. As of Jan 1, she will be homeless and unemployed there.
My question has 2 parts.
1. Can she possibly just serve the 30 sentence and forgo the probation requirements? (I am assuming that restitution and fees will be required as well)
2. How do courts generally handle situations where someone is in a unemployed/housing situation like this?
It looks like probation transfer can take a lot longer to take effect than she has. Any advice or direction is greatly appreciated.
