    Default Accused of Defamation for Calling Somebody a Scammer

    My question involves defamation in the state of: Tennessee

    This guy was selling something on craigslist. He asked for a phone number to be included on the email. I don't want to give my phone number out to random people so I withhold it. He sends me back some really wierd responds saying very childish things like "you're so fat" or "your questions are really dumb." The questions were about his item such as the condition. After that response he blocked my email so I could not respond to him.

    Well he made another posting for something and I had a friend contact him. He again responded with very childish answers. They had a little arguement via email. My friend made a posting saying the guy was a scammer. The guy selling the item then put on the bottom of his ad that someone has been contacting him and the item was actually good quality.

    Anyway, the guy's ad was deleted along with the ad saying he was a scammer. He contacted my friend saying that he knows who it was that posted the scammer ad and he has the IP address from the emails from my buddy. He also said that he's contacting a lawyer and giving a deposition because that is slander. The item was being sold for $25 and he has been listing it for months. Putting it up for a short time and then it comes down.

    Does this guy have legal recourse? or is he just trying to scare him and me (because he thinks it's me)?

    To prove a case for defamation, absent the relatively unusual circumstances in which damages are presumed, you have to be able to show that you were damaged as part of your case in chief. It's not clear what the damage claim would be.

    You're all in Tennessee? If the guy wants, there's nothing to stop him from suing your friend in small claims court, but I doubt he's going to lay out thousands of dollars to hire a lawyer.

    Thanks for the help. I told him not to worry too much about it. It's only for an item he wants 25 dollars for.

    This all sounds pretty convoluted to me. It sounds to me like this guy just likes to pick a fight. I would just totally disengage from the whole situation if it was me.
