    Default Do I Need a Laywer for a Drug Charge

    My question involves criminal records for the state of:

    I was charged with possession of marijuana, and it was my first offense. I live in Michigan and have heard of the 7411 law where I can get it off of my record.
    My question is do I need a lawyer to do this? I haven't received my court date yet, but when I do do I have to bring a lawyer or will one be provided for me then or do I just ask the judge for a 7411?

    If you can afford a lawyer, it would be in your best interest to hire one.

    Asking for a public defender would be your second best bet if you can't afford to pay a lawyer on your own.

    I wouldn't suggest entering a court room on your own and try to beat a drug charge. One thing a judge doesn't like is a person with no law degree thinking that they are smarter them him.
    I'm not a lawyer, but I did stay at a Holiday Inn Express last night.......

    If you are comfortable with the idea of trying to negotiate directly with the prosecutor, you would be able to try at the pretrial and perhaps at the arraignment (although prosecutors aren't always present at arraignment), and can raise the question of 7411 at that time. A lawyer would be more familiar with how to formally raise the possibility of a 7411 sentence, and I would be very hesitant to tell anybody who is facing a criminal charge not to at least consult a lawyer.

    My advice to to anyone facing criminal charges is to hire as much "lawyering" you can afford. Treating pending criminal charges as a dot-it-yourself project usually turn out badly.
