    Default Violation of Probation With only 3 Months to Go

    My question involves criminal law for the state of: FLORIDA

    MY HUSBAND VIOLATED A 30 MONTH PROBATION. HE DIDN'T RECEIVE ANY NEW CHARGES. HIS URINE WAS DIRTY AND THEY VIOLATED HIM. HE COMPLETED 27 MONTHS! HE WAS TAKEN INTO CUSTODY WITH MIAMI-DADE COUNTY, BUT HAD TO BE EXPEDITED TO MONROE COUNTY DUE TO AN OUT OF COUNTY WARRANT. BY IT BEING HIS FIRST VIOLATION WITH NO NEW CHARGES AND ONLY 3 MONTHS LEFT TO COMPLETE, WHAT ARE WE LOOKING AT?

    He could be looking at the time he was facing prior to being placed on probation. A warrant and a dirty drop? That's not encouraging for him.

    Thank you for responding viol8te. The warrant was issued because of the dirty drop from the month before. His probation was with monroe county, but because we reside in miami-dade county we had his probation switched to dade so that we wouldn't have to keep traveling to the keys for probation. The month before he had a dirty drop and his po let him go, but i guess he reported it anyway. When i took him for his november drop they kept him because monroe issued a warrant for violation of his probation due to the dirty drop from october. Smh.....3 months to go. So upset with him!!!!

    Well, per the compact, your county is bound to tell the sentencing county of the violation. The PO he reports to in your county has no say in whether or not they violate. In this case Monroe violated. Being that he has just one dirty drop in 27 months, it's a little more encouraging than what I thought you were saying in the original post.

    Thank you for responding. I really feel more at ease. He goes in front of the judge on december 15th. I'm praying he comes home.....
